Terms of service

These terms are an agreement between you and Riso Development LLC ("steppix", "we", "us"), a Florida limited liability company, about your use of the steppix app and steppix.app (together, the "service"). By creating an account or using the service, you agree to these terms, the official contest rules and the privacy policy. Please read section 17: it requires most disputes to be resolved by individual arbitration and waives class actions.

1. What steppix is

Steppix is a skill-based fitness contest. You join step challenges, try to hit a daily step goal every day, and everyone who finishes splits the prize pool under the official contest rules. Whether you finish depends on your own walking. Steppix doesn't offer games of chance, doesn't set odds, and never plays against you.

There's no guarantee you'll win anything. If you don't finish a paid challenge, you lose your entry. Payout estimates are estimates. Only enter what you're comfortable leaving behind, and see responsible play.

2. Eligibility and your account

  • You must be at least 13 to use steppix. To join paid challenges or cash out you must meet the age and location requirements on the eligibility page: at least 18 (older in some states) and physically located in the United States where paid challenges are available.
  • One account per person. Don't create or use more than one account, share an account, or use someone else's.
  • Keep your sign-in secure. You're responsible for activity on your account.
  • The information you give us (including your date of birth) must be true. We may ask you to verify your identity, age or location, and may suspend paid features until you do.

3. Paid challenges, fees and your wallet

  • When you join a paid challenge, you pay the entry plus a service fee of 10% + $0.30, shown before you confirm. Entries go into the prize pool; the service fee doesn't.
  • Steppix takes nothing out of the prize pool: the whole pool goes to finishers, as described in the official contest rules.
  • Winnings, refunds and other amounts owed to you are held in your steppix wallet as a record of what we owe you. Your wallet balance isn't a bank account or stored-value account and doesn't earn interest.
  • Payments, identity verification and payouts are handled by our payments provider, Whop, under its own terms. Before your first cash-out you'll complete an identity check with Whop. We may delay or refuse a payout while we verify identity, eligibility or fair play, or where the law requires.
  • Cash-out minimums, limits and fees are shown in the app and in the official contest rules. Bank transfers are free.
  • Entry credit (for example welcome and referral credit) is promotional, non-cash credit. It can pay for entries (not service fees), can't be withdrawn or transferred, has no cash value, and is forfeited if your account closes.

4. Taxes

You're responsible for any taxes on your winnings. Where required by law, we'll collect tax information from you and issue tax forms, and we may withhold payouts until you provide what the law requires.

5. Referral program

  • When 3 people who sign up with your invite link or code each complete their first paid entry, you receive $10 of entry credit. A person can be linked to one inviter, once, during sign-up.
  • New players may receive $5 of entry credit after their first paid entry of $20 or more.
  • Credit is issued while the program runs and within its total budget. We may change or end the program at any time; credit you've already received stays yours under these terms.
  • Self-referrals, referrals between accounts controlled by the same person, and referrals obtained through spam, fake accounts or misleading claims don't count. We may remove credit obtained that way and close the accounts involved.

6. Fair play and prohibited conduct

You agree not to:

  • submit steps you didn't walk, or use any device, app, machine or method to generate or alter step data (including shakers, swings, pets, vehicles, or editing Health data);
  • create or use multiple accounts, or let someone else walk for your account;
  • use a VPN, proxy or anything else to hide or fake your location;
  • collude with other players to manipulate a result;
  • reverse engineer, scrape, overload or interfere with the service;
  • harass anyone, impersonate anyone, or post anything illegal, hateful or infringing;
  • use steppix if you're not eligible or where it's prohibited.

7. Reviews, suspension and forfeiture

We check step data automatically and may hold a payout while a person reviews it (see the official contest rules). If we reasonably determine that you broke these terms or the rules, we may disqualify your entries, forfeit winnings and entries connected to the violation, remove credit, suspend or close your account, and report illegal activity to authorities. If we close your account for a reason other than a violation, we'll pay out your remaining cash balance (subject to identity verification and the law). You can ask us to explain or reconsider a decision by emailing support@steppix.app.

8. Steppix+

Steppix+ is an optional auto-renewing subscription sold through the App Store. It's covered by the subscription terms. Steppix+ never changes fees, prize pools, payouts or anyone's chance of finishing.

9. Your content

You own what you post (like your display name, profile photo and pledge). You give us a non-exclusive, worldwide, royalty-free licence to host, display and use it to run and promote the service, for as long as it's on steppix. Don't post anything you don't have the right to share. We may remove content that breaks these terms.

10. Our intellectual property

The service, including the steppix name, the wordmark, Kicks the sneaker, the app and the website, belongs to Riso Development LLC and is protected by law. We give you a personal, revocable, non-transferable licence to use the app for its intended purpose. Feedback you send us may be used without obligation to you.

11. Health

Steppix isn't medical advice. Talk to a doctor before starting a new exercise routine, and stop if you feel pain or unwell. Never walk somewhere unsafe to hit a goal. You take part in physical activity at your own risk.

12. Changes to the service and these terms

We may change the service. We may update these terms; if a change is material, we'll tell you in the app or by email before it takes effect. Changes never apply to a challenge you've already joined. If you don't agree, stop using steppix and close your account.

13. Ending your account

You can close your account at any time in Settings or on the delete account page. We may suspend or close accounts as described in section 7. Sections that by their nature should survive (including 3, 4, 7, 9–11 and 14–19) survive.

14. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the service will be uninterrupted or error-free, that Apple Health or your device will record or sync every step, or that you'll win anything. Our commitment to correct results affected by our own system errors is in the official contest rules.

15. Limitation of liability

To the fullest extent the law allows, steppix and its members, managers, employees and providers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the service is limited to the greater of (a) the entries and fees you paid us in the 6 months before the claim and (b) $100. Some places don't allow these limits, so they may not apply to you in full.

16. Indemnity

You'll defend and indemnify steppix against claims, losses and costs (including reasonable legal fees) arising from your breach of these terms or the rules, your content, or your violation of law or someone else's rights.

17. Disputes, arbitration and class-action waiver

  • Talk to us first. Email support@steppix.app with your name, username and the problem. Most issues are fixed this way. If we can't resolve it within 60 days, either of us may start arbitration.
  • Arbitration. Except for small-claims cases and claims about intellectual property, any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in the county where you live or by video, and we'll pay filing and arbitrator fees as those rules require.
  • Class-action waiver. You and steppix may bring claims only individually, not as a plaintiff or class member in any class, consolidated or representative action. If this waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration.
  • Opt out. You can opt out of arbitration by emailing support@steppix.app within 30 days after you first accept these terms, with your name and username.
  • Governing law. These terms are governed by the laws of the State of Florida and the Federal Arbitration Act, without regard to conflict-of-law rules. For any claim not subject to arbitration, you and we agree to the courts located in Collier County, Florida.

18. App Store terms

If you got steppix from Apple's App Store:

  • These terms are between you and Riso Development LLC only, not Apple. Apple isn't responsible for the app or its content.
  • Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store's Usage Rules.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
  • Riso Development LLC, not Apple, is responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
  • If anyone claims the app infringes their intellectual property, Riso Development LLC, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm you're not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and you're not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
  • Apple is not a sponsor of, and is not involved in, any steppix contest.

19. General

These terms, the rules, the subscription terms and the privacy policy are the whole agreement between us. If part of these terms is unenforceable, the rest stays in effect. If we don't enforce something, we haven't waived it. You can't transfer these terms; we may transfer them as part of a merger or sale of the business.
